DMCA POLICY

BoastIt LLC (“BoastIt”) respects the intellectual property rights of others and complies with the U.S. Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512. If you believe content on the Service infringes a copyright you own or control, you may submit a takedown notice as described below.

How to submit a DMCA takedown notice

Email your notice to support [at] boastit [dot] app. We aim to respond to properly formatted notices within 5 business days.

Under 17 U.S.C. § 512(c)(3), a valid notice must include all of the following:

  1. A physical or electronic signature of the copyright owner, or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed (or, for multiple works, a representative list).
  3. Identification of the material that is claimed to be infringing, with enough detail for us to locate it on the Service (a direct URL is best).
  4. Your contact information: name, mailing address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf.

Note:Submitting a knowingly false DMCA notice may expose you to liability for damages, including costs and attorneys' fees, under 17 U.S.C. § 512(f).

Counter-notice

If you believe content of yours was removed in error, you may submit a counter-notice to support [at] boastit [dot] app. Under 17 U.S.C. § 512(g)(3), a valid counter-notice must include:

  1. Your physical or electronic signature.
  2. Identification of the material that was removed and the location where it appeared before removal.
  3. A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or, if outside the United States, the federal district court for any judicial district in which BoastIt may be found), and that you will accept service of process from the person who provided the original DMCA notice or that person's agent.

Repeat infringers

BoastIt maintains a policy of terminating, in appropriate circumstances, the accounts of users who are determined to be repeat infringers.
